4. ARENA X LIABILITY AND LIMITATION OF LIABILITY
4.1. Arena X provides the event venue and facilities in accordance with its agreed role in the event. The co-hosting company is responsible for the activities, services and obligations allocated to it under the parties' written arrangements.
4.2. To the extent permitted by applicable South African law, Arena X and the co-hosting company do not accept liability for loss, injury or damage arising solely from inherent risks of voluntary participation, provided that such loss, injury or damage was not caused by a breach of an applicable legal duty for which the relevant party is responsible.
4.3. Arena X will not be liable for the independent acts or omissions of the co-hosting company, its contractors, trainers or other third parties merely because the event takes place at Arena X. This does not exclude liability that may legally attach to Arena X for its own acts, omissions or responsibilities.
4.4. Participants remain responsible for exercising appropriate care, following safety instructions and providing accurate information relevant to their participation.
4.5. Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law, including applicable statutory consumer protections and liability that cannot lawfully be excluded.

5.3. No participant is required by this clause to indemnify Arena X or the co-hosting company for liability that cannot lawfully be transferred, including liability arising from circumstances where such an indemnity would be unlawful or unenforceable.
5.4. This clause does not prevent a participant from exercising any legal right or remedy available under South African law.
